What if the
company or pension plan does not pay you upon presentation?
You will need
legal representation if the company holding the asset does not
pay you upon presentation.
California has
strict rules about companies which do not comply with the
Affidavit of Small Estate and refuse to pay, allowing you to
bring a court action and recover the asset and the attorneys
fees.
What other type
of advice will I need?
You will also need
tax advice if the asset you are collecting was a tax deferred
asset. If you don't know whether or not an asset is tax deferred,
you will need legal advice and tax advice.
How do I retain
your firm to collect the asset?
Email
Us with the facts relating to your case, then call our office
at 818-340-4479 for a telephone consultation. We must be formally
retained to be able to advise you. We will send you a fee
agreement for your review and address various methods of
collection.
In order to be
able to represent you, the asset you are collecting must be
located in California OR you must be a California resident.
Do you accept
contingency cases to collect these assets?
On occasion, we
evaluate each case to see if it is appropriate for a contingency
fee arrangement. Not every case is a good fit for a contingency
fee arrangement. Please email us if you need representation on a
contingency fee basis relating to collection based on a Small
Estate Affidavit.
What are the

interest debt such as credit cards.
