WILL vs. POUR-OVER WILL
When a person creates a trust, he or she normally prepares a pour-over
will with it. A Pour-over (pourover or pour over) will
simply instructs that once
the assets outside of trust are collected, they are to be returned to
the trust for distribution there. Both wills are fairly
simple, but a pour-over will leaves the residue all to the trust.
CAN ASSETS OUTSIDE OF THE
TRUST BE PUT IN THE TRUST AFTER DEATH?
Generally, a pourover will or a
Heggstad petition is used to put assets which are left out of the
trust,
back in the trust.
WHAT IS A TESTAMENTARY TRUST?
In the old days, before living trusts came by, trusts were court
supervised. Those trusts were called testamentary trusts.
Now, living trusts are created with the goal of avoiding court
supervision.
